Objective
Students can describe the major elements of the legal principles behind international contracts and know their significance in sales contracts. Students can identify the areas most likely to cause concern in relation to contract negotiation and formation. Students uunderstand the method of establishing the applicable law in any given case Students are able to read and understand the significance of standard contract wordings. Students are fully familiar with legislation relating to Sale of Goods, in particular the obligations placed on the buyer and seller by the CISG Students are able to research law related issues Students understand the concept of tort and its place in business law, the EU as a business law maker, are familiar with international carriage conventions, the law of agency, aspects of marketing and commercial property law.
Content
The concept of international law, the ideas of public and private law, a view of legal systems and the hierarchy of the law and court systems. The principles of contract in common law and certain statute laws relating to the sale of goods examined in detail. The application and extent of the United Nations Convention on Contracts for the International Sale of Goods and the common law concepts and statute law provisions examined earlier will be compared and contrasted therewith. The concept of tort and its implications for businesses, the EU as a business law maker, laws relating to the international movement of goods, agency, and aspects of marketing and commercial property law.
